Very delicate all this…I told her also clearly that we would need some support in Daksha´s case, as ACT doesn´t have sufficient funding left. Why should ACT ( specifically Roelie) pay the expenses of such cases??? When then organisations promoting ICA and Hague system- use this and our Indian contacts to make a search business???? While keeping ACT an arms lengths away? It is this kind of social workers who created that mess.We need to clean it up? While they continue to make their business? So shall I sent out below letter? Suggestions welcomed…..anyway Pia is now going on Thursday for 10 days holiday…hmmmm What to do? Dear Pia, following our phone conversation, i m sending you the new CARA draft guidelines.Please go through them and you will see, that in future this will make searches for adoptees much more difficult.These part of the guidelines, comes in on initiative of the Wereldkinderen Partner orphanage Bal Anand ( Sulu Kalro). She is also head of the federation of maharashtrian agencies.None of the formal CARA committee members, was involved in the drafting process. All this happened informally behind closed doors.Wereldkinderen took the easy way out and continues to cooperate with Sulu. They are now conveying to the new CARA guidelines. At the same time- ACT took over the case of Daksha van Dijk. – a Wereldkinderen case.Her case is now pending on the Bombay High Court and reached a crucial state. The good thing is, that the orphanage doesn´t deny the existence of records. But of course they deny any openness and further hide behind the “ privacy of the unwed mother” argument and clearly state that they will never disclose the identity. The case comes up for a major argument on 22nd October. It is crucial that Daksha ( she can take care of her own expenses) and myself would be there personally in order to take care of all things. Most likely it would make a big difference. A loss of this case, would clearly have huge implications for all adoptee´s who want to search. – certainly any High Court Order which clearly stipulates that the orphanages have to protect the privacy of the mothers, would make almost all searches next to impossible and would play the agencies and CARA in the hand with the new CARA guidelines. Any kind of success in Daksha´s case- may in the best case scenario, make it mandatory for the Indian orphanages to disclose the identity.Anything in between is also possible. But what clearly needs to be prevented, is that Daksha´s orphanage obtains an order which is 100 % in their favour.This will have then devastating consequences for all adoptees. Due to lot´s of case load, ACT currently doesn´t have enough funding for the work and travel expenses which need to be done. It´s very sad to witness how a missing few hundred Euro´s make the difference. Would it be possible for Triobla to support ACT in pursuing Daksha´s matter? Kindly let me know as soon as possible.
