Parents troubled by adopted child, approach police:Allege repeated violence, seek to return him but cops cite law, say it is not possible

An elderly couple in Ajmer has approached the police, asking to be freed from the responsibility of their adopted child. They requested that the child be sent to the Child Welfare Committee, Childline, or any other government care institution.

Following their request, the police asked the couple to produce documents related to the adoption and later sent them back. The police then sought guidance from the district Child Protection Committee on how to proceed in the matter.

The committee informed the police that the child had been adopted from a relative and that the legal adoption process had not been followed. In view of the child’s future, the committee said the child cannot be taken back or handed over to any institution at this stage.

Parents accuse child

ASI Bharti of Civil Lines police station stated that on Wednesday evening, the elderly couple came. They said that about 2 years ago, they had adopted a child from their relative.

At that time, he was about 12 years old. Now he is 14 years old, but he is aggressive and engages in violence. Therefore, they want to return him.

The relatives from whom the child was adopted do not want to take the child back. In such a situation, they want the child to be returned through the Child Welfare Committee.

The child wants to stay with the couple - President

According to ASI, the couple did not have a legal adoption deed, so the President of the Child Welfare Committee was consulted. She had said that if there are no adoption-related documents, the child cannot be taken back.

Child Welfare Committee President Anjali Sharma said that a social investigation report was also prepared. The child was spoken to, but he wants to stay with the couple.

The child has not been adopted through legal process - CWC

The adoption process is completed legally. There is no other option for adoption. He said that only a Hindu family can adopt a child from another Hindu family. This is also recognized, but this family does not fall under the Hindu Adoptions and Maintenance Act (HAMA) category either. The child was not legally adopted.

Therefore, the child can only be returned to the family from whom he was taken. That too will only happen after fulfilling the legal aspects. The child's future will be considered first.
