Less bureaucracy and more state support in adoption processes

The Ministry of Labor announced that the Government approved on Wednesday the Methodological Norms for the application of the Adoption Law, which makes the procedures more flexible and increases the state support provided to the adoptive families.

According to a communiqué of the Ministry of Labor, the normative act ensures equitable access for entry on the lists in the matching process for all adopters or adoptive families, establishing a single ranking criterion, namely the seniority of the certificates. It also provides for the obligation to notify the adopter or adoptive family of the outcome of the match, the reasons why the practical matching procedure has not been initiated and the setting of a deadline for this.

„The document adopted today also establishes the procedure for granting the monetary rights provided by Law no. 268/2020, respectively the support allowance and the fixed amount in the amount of 1,500 lei, through the payment and social inspection agencies of the county and of the municipality of Bucharest ”, it is also shown in the communiqué.

According to him, considering the extension of the validity of the certificate from 2 years to 5 years, the norms of application of the law establish the procedure of annual verification of the fulfillment of the conditions that were the basis for the issuance of the certificate. The verification involves at least a visit to the home of the adopter / adoptive family and a psychological counseling session at least 60 days before the deadline of one year from the issuance of the certificate or, as the case may be, from the last assessment.

Excessive bureaucratization of certain stages of the adoption process will be eliminated

The maximum period during which the practical adjustment can take place has been set at 3 months from the agreement of the adopter or the adoptive family regarding the continuation of the practical adjustment procedure.

Also, the counseling of the child by the psychologist of the multidisciplinary team becomes mandatory after each practical match stopped during which he had at least one meeting of the child with the adopter / adoptive family.

"The norms for the application of the Adoption Law introduce a legislative solution for the child in the situation where during the practical adjustment he does not accommodate with the adopter, establishing that in this case the initial matching procedure is resumed", the Ministry of Labor also informed.

According to him, the excessive bureaucracy of certain stages of the adoption process will be eliminated, by replacing the legalized copies with certain documents with copies certified for conformity with the original.

At the end of June, the number of certified families was 3,172, increasing compared to previous years, and the number of children declared adoptable increased by over 35% compared to the average of previous years, reaching 4,850.

Va fi eliminat? birocratizarea excesiv? a anumitor etape ale procesului de adop?ie

Ministerul Muncii a anun?at c? Guvernul a aprobat miercuri Normele metodologice de aplicare a Legii adop?iei, care flexibilizeaz? procedurile ?i cre?te sprijinul acordat de stat familiilor care adopt?.

Potrivit unui comunicat al Ministerului Muncii, actul normativ asigur? accesul echitabil pentru intrarea pe liste în procesul de potrivire pentru to?i adoptatorii sau familiile adoptatoare, stabilind un singur criteriu de ierarhizare, respectiv vechimea atestatelor. De asemenea, acesta prevede obligativitatea anun??rii adoptatorului sau familiei adoptatoare cu privire la rezultatul potrivirii, prezentarea motivelor pentru care procedura de potrivire practic? nu a fost ini?iat? ?i stabilirea unui termen în acest sens.

„Documentul adoptat ast?zi stabile?te ?i procedura de acordare a drepturilor b?ne?ti prev?zute de Legea nr. 268/2020, respectiv indemniza?ia de sprijin ?i suma fix? în cuantum de 1.500 lei, prin agen?iile pentru pl??i ?i inspec?ie social? jude?ene ?i a municipiului Bucure?ti”, se mai arat? în comunicat.

Conform acestuia, având în vedere prelungirea valabilit??ii atestatului de la 2 ani la 5 ani, normele de aplicare ale legii stabilesc procedura de verificare anual? a îndeplinirii condi?iilor care au stat la baza eliber?rii atestatului. Verificarea presupune realizarea cel pu?in a unei vizite la domiciliul adoptatorului/familiei adoptatoare ?i a unei ?edin?e de consiliere psihologic? cu cel pu?in 60 de zile înainte de împlinirea termenului de un an de la eliberarea atestatului sau, dup? caz, de la ultima evaluare.

Perioada maxim? în care se poate derula potrivirea practic? a fost stabilit? la 3 luni de la acordul adoptatorului sau al familiei adoptatoare cu privire la continuarea procedurii de potrivire practic?.

De asemenea, consilierea copilului de c?tre psihologul echipei multidisciplinare devine obligatorie dup? fiecare potrivire practic? încetat? în cadrul c?reia a avut cel pu?in o întâlnire a copilului cu adoptatorul/familia adoptatoare.

„Normele de aplicare a Legii adop?iei introduc o solu?ie legislativ? pentru copil în situa?ia în care pe parcursul potrivirii practice acesta nu se acomodeaz? cu adoptatorul, stabilindu-se c? în acest caz se reia procedura de potrivire ini?ial?”, a mai informat Ministerul Muncii.

Potrivit acestuia, va fi eliminat? birocratizarea excesiv? a anumitor etape ale procesului de adop?ie, prin înlocuirea copiilor legalizate dup? anumite documente cu copii certificate pentru conformitate cu originalul.

La sfâr?itul lunii iunie, num?rul familiilor atestate era de 3.172, în cre?tere fa?? de anii preceden?i, iar num?rul copiilor declara?i adoptabili a crescut cu peste 35% fa?? de media anilor preceden?i, ajungând la 4.850.
