Marie is two years old. Marie is funny. They prefer to go with grandpa on the tractor or playing with Tom and Jan in the mud. That Opi not her real grandfather and Tom and Jan are their real brothers do not know Marie. The girl came at the age of three months under dubious conditions from Romania to Germany. A private initiative of two women from Hammelburg Astrid R. meets (all names have been changed, the editorial office) in late 2006 in a village near the Romanian town Lipova to little Mary, then, the youngest of nine children. "The conditions there were deplorable," she recalls. First, they have agreed in writing with their own parents for a temporary guardianship, says Astrid R. Rumänisches Mädchen beschäftigt Ämter und Behörden
Marie ist zwei Jahre alt. Marie ist drollig. Am liebsten fährt sie mit Opi auf dem Traktor oder spielt mit Tom und Jan im Matsch. Dass Opi nicht ihr echter Großvater und Tom und Jan nicht ihre echten Brüder sind, weiß Marie nicht. Das Mädchen kam im Alter von drei Monaten unter zweifelhaften Bedingungen aus Rumänien nach Deutschland. Diese beschäftigten vergangene Woche das Gericht, das die Drahtzieherinnen wegen Menschenhandels verurteilte (wir berichteten). Das weitere Schicksal des Mädchens aber ist ungeklärt.

Über eine private Initiative zweier Frauen aus Hammelburg trifft Astrid R. (alle Namen geändert, die Red.) Ende 2006 in einem Dorf nahe der rumänischen Stadt Lipova auf die kleine Marie, damals das jüngste von insgesamt neun Kindern. „Die Umstände dort waren erbärmlich", erinnert sie sich. Zunächst habe sie mit den leiblichen Eltern schriftlich eine zeitlich befristete Pflegschaft vereinbart, erzählt Astrid R. „Anschließend sollte die Pflegschaft in eine Adoption münden."
Die Behördengänge erledigt sie mit jener Rumänin aus Hammelburg. Sie habe sich auf deren Integrität und deren angeblich gute Kontakte zu den richtigen Leuten verlassen, sagt Astrid R. „Ich verstehe ja die Sprache nicht." Sie habe auf Anraten ihrer Begleiterin auch Schmiergeld bezahlt, damit Formalitäten schneller vonstatten gingen, gibt sie zu.
Kaum hatte Astrid R. Marie mit nach Deutschland gebracht und mit dem Jugendamt wegen eines Pflegegeldantrags Kontakt aufgenommen, begannen die Probleme, erzählt sie. „Es hieß, wir sollten das Kind zurückbringen. Eine Adoption rumänischer Kinder sei nur durch Verwandte möglich." Das habe sie nicht gewusst, beteuert Astrid R., Marie zurückbringen will sie auf keinen Fall. „Damals war sie halb verhungert." Die Kleine hätte in Rumänien nicht überlebt, ist sich Astrid R. sicher.
Seit zwei Jahren lebt Marie im Landkreis Bad Kissingen. Sie mag Pippi Langstrumpf und das Sandmännchen. Der quirlige Blondschopf klettert auf die Sitzbank im Esszimmer und schnappt sich ein Stück Schokolade. „Sie ist uns so sehr ans Herz gewachsen", sagt Pflegeoma Karin. Familie R. will deshalb alles tun, damit Marie dauerhaft bei ihnen bleiben kann.
Doch rechtlich gesehen befindet sich Marie „in einer Art Grauzone", wie es ein Mitarbeiter der Ausländerbehörde am Landratsamt formuliert. Eine notariell beglaubigte Erklärung der leiblichen Eltern sichert Familie R. noch bis Mitte nächsten Jahres die Pflegschaft für Marie zu. Dann hat das Kind insgesamt dreieinhalb Jahre in Deutschland verbracht. Was danach kommt, ist ungewiss.
„Das Jugendamt steht in Verbindung mit dem rumänischen Konsulat", so Anna Barbara Keck, Abteilungsleiterin für kommunale und soziale Angelegenheiten am Landratsamt auf Anfrage der Main-Post. „Wir können schon seit Wochen keinen persönlichen Kontakt zu den leiblichen Eltern mehr herstellen", beklagt Astrid R.
Doch ohne Zustimmung der weiterhin sorgeberechtigten Eltern in Rumänien sind den Pflegeeltern in allen Entscheidungen bezüglich Marie die Hände gebunden. Einen Antrag der Eheleute R. auf Vormundschaft hat ein Familienrichter des Amtsgerichts Bad Kissingen abgelehnt. „Eine Vormundschaft ist nur möglich, wenn die elterliche Sorge nicht gewährleistet werden kann", erklärt der Richter auf Anfrage. Dies habe er in diesem Fall als nicht gegeben gesehen.
Astrid R. ist ganz anderer Ansicht. „Wie kann ein Richter meinen, die Eltern in Rumänien könnten genauso gut für das Kind sorgen wie wir hier? Die haben doch nichts!" Keck bestätigt, dass das Kind bei seinen Pflegeeltern sehr gut aufgehoben sei und dass für das Jugendamt „das Kindeswohl an erster Stelle" stehe.
„Von unserer Seite gibt es keinen Zwang, dass das Kind nach Rumänien zurück muss", so ein Mitarbeiter der Ausländerbehörde. Es sei ja nicht illegal da und sei krankenversichert. „Der Knackpunkt ist, dass das Kind ohne die sorgeberechtigten Eltern in Deutschland ist. Deshalb ist es laut EU-Gesetz nicht freizügigkeitsberechtigt. Anders wäre es bei einer Adoption, aber die ist ja in diesem Fall nicht möglich." Vieles sei im Fall Marie einfach schon von vorneherein dumm gelaufen, bedauert der Verwaltungsbeamte. Dass es für das Kind eine rechtlich saubere Lösung geben muss, darin sind sich Jugendamt, Familiengericht und Ausländerbehörde einig. Wann es soweit sein wird, hänge in erster Linie von den rumänischen Behörden ab, so Keck. „Möglichkeiten gibt es immer."
Astrid R. flüchtet sich mittlerweile in ihrer Sorge um Maries Zukunft in Galgenhumor: „Wenn wir ein Eisbärenbaby Knut hätten, hätte man längst Lösungen gefunden." Marie hopst derweil quietschvergnügt auf Pflegepapas Schoß.
