Belgium stops Moroccan adoption
For the time being, Flanders is completely refraining from adopting adopted children from Morocco.
The reason for this is the lack of clarity about the legal aspects of children from Morocco. According to De Standaard there is a lot of uncertainty about the recognition of adopted children once they are in Belgium. The first adoption request from Flemish parents went completely wrong in Ghent. Approximately eighty children from Morocco have been adopted in Brussels and Wallonia, but parents still have to do a lot of work to get recognition.
The Flemish parents did everything according to the adoption procedures, which meant that the ties with the biological parents should not be broken. However, the public prosecutor decided to appeal, after which the adoption was rejected. In Morocco there is only the 'kafala', a foster guardianship system and not the adoption schemes that we know in the Netherlands and Belgium.
However, there is something to be said for refusing the adoption. The name of the biological father is on the birth certificate of the child and it is precisely that the father did not give permission for the adoption. The 4-year-old boy has been living in Belgium with his foster parents for two years now. Adoption officer Ariana van Den Berghe has indicated that no Moroccan children may be adopted for the time being.
The civil servant awaits the appeal of Christophe and Zamira, who for the time being have no legal connection with their son. The Moroccan judge decided to officially grant the child.

Vlaanderen ziet voorlopig volledig af van het goedkeuren van adoptiekinderen uit Marokko.
Reden hiervoor is de onduidelijkheid over juridische aspecten van kinderen uit Marokko. Volgens De Standaard bestaat er vooral veel onduidelijkheid over de erkenning van adoptiekinderen als ze eenmaal in België zijn. De eerste adoptieaanvraag van Vlaamse ouders liep volledig mis in Gent. Ongeveer tachtig kinderen uit Marokko zijn in Brussel en Wallonië geadopteerd maar ouders moeten nog veel werk verzetten om erkenning te krijgen.
De Vlaamse ouders deden alles volgens de adoptieprocedures, wat betekende dat de banden met de biologische ouders niet verbroken mogen worden. Het parket besloot echter om in hoger beroep te gaan waarna de adoptie werd afgewezen. In Marokko bestaat namelijk alleen de 'kafala', een pleegvoogdijsysteem en niet de adoptieregelingen die we in Nederland en België kennen.
Er valt echter wel wat te zeggen voor het weigeren van de adoptie. De naam van de biologische vader staat namelijk op de geboorteakte van het kind en laat nou net de vader geen toestemming hebben gegeven voor de adoptie. Het 4-jarig jongetje is inmiddels al twee jaar woonachtig in België bij zijn pleegouders. Adoptieambtenaar Ariana van Den Berghe heeft laten weten dat er voorlopig geen Marokkaanse kinderen geadopteerd mogen worden.
De ambtenaar wacht het hoger beroep van Christophe en Zamira af, die vooralsnog geen enkele juridische band met hun zoon hebben. De Marokkaanse rechter besloot het kind wel officieel toe te kennen.
