Questions from members Van Nispen (SP) and Van Toorenburg (CDA) to the Minister for Legal Protection about abuses in adoptions and the involvement and science of the Dutch government (submitted 15 November 2019).

Question 1

Have you taken note of the broadcast of Nieuwsuur which shows that there is probably a lot wrong with adoptions from countries such as India and China and that the Dutch government was aware of these abuses? 1

Question 2

Do you also see that the cases that have since been investigated by the Joustra Commission and that are cited in the broadcast of Nieuwsuur are almost impossible to stand on their own and that it appears that the Ministries of Foreign Affairs and of Justice and Have safety failed to protect children against illegal adoption? If not, why not?

Question 3

Do you share the opinion that adopters are entitled to know exactly how their adoption went, where exactly they come from and who their real parents are? If so, are you willing to actually assist them in their search for their origin, precisely because of the involvement, responsibility or even the possible failure of the Dutch government?

Question 4

Do you share the opinion that the investigation that is already underway into the role and responsibility of the Dutch government in past adoptions (Joustra Committee) should be broadened so that it becomes clear once and for all what went well and what went wrong? Are you willing to certainly include China and India, but also Haiti for example, in the research? If not, why not? 2

Question 5

What is your reaction to the statement that the Dutch government should rely less on information from other countries and on the contrary ensure better supervision, and if it cannot be guaranteed that the correct and complete information is traceable, the adoption simply will not go ahead ?

Question 6

What possibilities do you think there are to monitor adoptions from China and to guarantee that such adoptions are pure and correct based on the correct information? Do you still find adoptions from China justified? In answering this question, can you also pay more specific attention to the vulnerable group of "special need" children?

Question 7

Do you also believe that the perverse incentive for financial gain should be removed from the system of adoptions? How do you think you can achieve this?

Question 8

When can the House expect the interim report from the Joustra Committee that it has already requested in response to the procedural meeting of the Justice and Security Committee on 19 June last? Can this interim report be sent to the House of Representatives on 11 December 2019 before the general consultation on personal and family law? If not, why not? 3

Can you answer these questions as quickly as possible, but certainly for the general consultation on personal and family law?

Vraag 1

Heeft u kennisgenomen van de uitzending van Nieuwsuur waar uit blijkt dat er waarschijnlijk veel mis is (geweest) met adopties vanuit landen als India en China en dat de Nederlandse overheid wetenschap had van deze misstanden?1

Vraag 2

Ziet u ook dat de zaken die inmiddels aanleiding zijn tot het onderzoek door de commissie Joustra en die in de uitzending van Nieuwsuur worden aangehaald haast niet op zichzelf kunnen staan en dat het er alle schijn van heeft dat de ministeries van Buitenlandse Zaken en van Justitie en Veiligheid tekort geschoten hebben in de bescherming van kinderen tegen illegale adoptie? Zo nee, waarom niet?

Vraag 3

Deelt u de mening dat geadopteerden er recht op hebben om te weten hoe hun adoptie precies verlopen is, waar ze precies vandaan komen en wie hun echte ouders zijn? Zo ja, bent u bereid om hen daadwerkelijk bij te staan in de zoektocht naar hun herkomst, juist ook vanwege de betrokkenheid, verantwoordelijkheid of zelfs het mogelijk tekortschieten van de Nederlandse overheid?

Vraag 4

Deelt u de mening dat het onderzoek dat al loopt naar de rol en verantwoordelijkheid van de Nederlandse overheid bij adopties in het verleden (commissie Joustra) moet worden verbreed zodat voor eens en altijd duidelijk wordt wat wel en niet goed is gegaan? Bent u bereid zeker ook China en India, maar bijvoorbeeld ook Haïti, mee te laten nemen in het onderzoek? Zo nee, waarom niet?2

Vraag 5

Wat is uw reactie op de stelling dat de Nederlandse overheid minder zou moeten vertrouwen op de informatie uit andere landen en juist moet zorgen voor beter eigen toezicht, en als niet gegarandeerd kan worden dat de juiste en volledige informatie traceerbaar is, de adoptie gewoon niet doorgaat?

Vraag 6

Welke mogelijkheden zijn er volgens u om toezicht te houden op adopties uit China en te garanderen dat dergelijke adopties zuiver en correct zijn op basis van de juiste informatie? Vindt u adopties uit China nog steeds verantwoord? Kunt u bij de beantwoording van deze vraag ook meer specifiek aandacht besteden aan de kwetsbare groep «special need»-kinderen?

Vraag 7

Bent u ook van mening dat de perverse prikkel van financieel gewin uit het stelsel van adopties gehaald moet worden? Hoe denkt u dit te kunnen bewerkstelligen?

Vraag 8

Wanneer kan de Kamer de tussenrapportage van de commissie Joustra verwachten waar zij naar aanleiding van de procedurevergadering van de commissie Justitie en Veiligheid d.d.19 juni jl. al om heeft verzocht? Kan deze tussenrapportage nog voor het algemeen overleg over personen- en familierecht op 11 december 2019 aan de Kamer worden gezonden? Zo nee, waarom niet?3

Kunt u deze vragen zo snel mogelijk, doch zeker voor het algemeen overleg over personen- en familierecht beantwoorden?
