Aus Thailand Kölner Paar gibt adoptiertes Mädchen wieder ab und bekommt Rechnung

It was the desire of the couple from the Cologne area to adopt a child. In Thailand, they found happiness in a home, as they thought. With support from the Provincial Youth Office, the couple returned with a 5-year-old girl back to Germany. After only about two weeks, the couple refrained from adopting again. And did not expect the follow-up costs.
The authorities presented the Cologne namely a hefty bill. From now on, they should pay for the placement of the child in Germany. At 100 euros per day, the costs amount, the amount must be paid for a period of six years. The result is a total of 219,000 euros. The couple filed a lawsuit against the district court.
The plaintiffs had stated that because of the child's eye-catching behavior, they were unable to continue with their adoption. The youth welfare office had deceived them in the mediation, concealed the mental problems of the child. They also assumed that they would have to pay a maximum of six months for further child-care.
Cologne: Child was already behaving in Thailand
The district court dismissed the complaint, so now the Higher Regional Court of Cologne in the next instance. An official breach of authority did not see the judges. Admittedly, the adoption report revealed that the child's father was a drug addict. Overall, however, the social and emotional development of the child in Thailand has been shown to be positive.
In addition, the plaintiffs had met the girl in Thailand for several days. "They could have made themselves a picture of the character of the child," said the judges. Also, the girl according to the couple still showed in Thailand behavioral problems in the form of spitting, kicking, biting and screaming. A return to Thailand was not provided, which was also aware of the couple.
The case is now to be examined by the Federal Court of Justice.

Es war der sehnlichste Wunsch des Paares aus dem Raum Köln, ein Kind zu adoptieren. In Thailand fanden sie ihr Glück in einem Heim, wie sie dachten. Mit Unterstützung des Landesjugendamtes kehrte das Paar mit einem 5-jährigen Mädchen zurück nach Deutschland. Bereits nach rund zwei Wochen nahm das Paar von der Adoption wieder Abstand. Und rechneten nicht mit den Folgekosten.
Köln: Paar muss 100 Euro am Tag für Kind zahlen
Die Behörden präsentierten den Kölnern nämlich eine saftige Rechnung. Fortan sollten sie für die Unterbringung des Kindes in Deutschland aufkommen. Auf 100 Euro pro Tag belaufen sich die Kosten, der Betrag müsse für einen Zeitraum von sechs Jahren gezahlt werden. Das macht im Ergebnis eine Summe von 219.000 Euro aus. Das Paar reichte dagegen Klage vorm Landgericht ein.
Die Kläger hatten angegeben, wegen des auffälligen Verhaltens des Kindes seien sie nicht in der Lage, die ausgemachte Adoptionspflege weiterzuführen. Das Jugendamt hätte sie bei der Vermittlung getäuscht, die psychischen Probleme des Kindes verschwiegen. Auch seien sie davon ausgegangen, höchstens sechs Monate für die weitere Kindes-Unterbringung zahlen zu müssen.
Köln: Kind war bereits in Thailand verhaltensauffällig
Das Landgericht wies die Klage ab, so auch nun das Oberlandesgericht Köln in der nächsten Instanz. Eine Amtspflichtverletzung der Behörde sahen die Richter nicht. Zwar habe sich aus dem Adoptionsbericht ergeben, dass der Vater des Kindes drogenabhängig gewesen sei. Insgesamt aber die soziale und emotionale Entwicklung des Kindes in Thailand als positiv dargestellt worden.
Dazu kam, dass die Kläger das Mädchen in Thailand über mehrere Tage kennen gelernt hatten. „Sie hätten sich selbst ein Bild vom Charakter des Kindes machen können“, so die Richter. Auch habe das Mädchen laut Paar noch in Thailand Verhaltensauffälligkeiten in Form von Anspucken, Treten, Beißen und Schreien gezeigt. Eine Rückkehr nach Thailand sei nicht vorgesehen, auch das sei dem Paar bewusst gewesen.
Der Fall soll nun vom Bundesgerichtshof geprüft werden.
