Acquis Communautaire, UNCRC acquis or not?
What they try to do since the enforced the correct implementation of the UN Convention on the Rights of the Child in Romania, is replacing the UNCRC with the Hague Adoption Convention. while saying that UNCRC is not acquis/legal basis.
The European Commission argues that article 24, Charter on Fundamental Rights is legal basis.
But that is based on UNCRC.
BUT: Charter does not give COM new competences.
Also did not undo the decision of the Council - 1998
The UNCRC was in 1998 considered inseparable from the Treaty - so primary EU law.
